Procedural order election of a preventive measure in the form of house arrest

The article analyzes the procedure for choosing a preventive measure in the form of house arrest. At the same time, there was a lack of regulation of the procedure for the immediate execution of a court decision on choosing a preventive measure in the form of house arrest. In addition, the article draws attention to the discrepancy between the powers of the court to choose a preventive measure in the form of house arrest to the principle of adversarial and equal rights of the parties. In order to increase the effectiveness of the application of preventive measures in the form of house arrest, the necessity of improving the legal regulation of the election and application of this preventive measure is substantiated.
