Understanding evidence in modern theory and practice of criminal procedure

The article discusses various approaches to the essence of the key concept of criminal proceedings-evidence and evidence. The concepts of understanding evidence both at the present stage and in the criminal procedure theory and practice of the RSFSR are revealed. As a methodological basis of the process of proof is the theory of knowledge, exploring the most common laws and patterns of cognitive activity. On this basis, the author characterizes the concepts of evidence and features of their application in practice in criminal proceedings. In conclusion, the author comes to the conclusion that the problem of understanding the evidence in the modern theory and practice of criminal proceedings is largely debatable, but the development of terminology is currently very relevant and is fundamental.
