Problems of disposal of shares in the right to agricultural land that is leased

The Author of the article examines the problematic issues of regulation of relations arising in the implementation of the rights of owners of shares of agricultural land plots encumbered with the right to lease such a plot. Based on the analysis of legal norms and judicial practice, the author identified the main problems of such implementation of the rights of owners of shares. According to the author, these problems are related to the fact that the encumbrance of shared property with the right to lease may also occur if individual participants disagree with such encumbrance. The only solution for such participants is to allocate their share. The consequence of this allocation may be complications for the tenant, who has burdened his lease right with collateral relations.
