Features of implementation of the principle of dispositivity in ordered production

This article examines the specifics of implementing the principle of dispositivity in writ proceedings, and examines the provisions of civil procedure and arbitration procedural legislation of the Russian Federation. Federal laws restricting the operation of the principle of dispositivity are identified. Sanctions are proposed for the applicant in case of abuse of the right, in case of non-motivated refusal to consider the case in writ proceedings.
