Problematic aspects of the division of common credit debts of spouses

In this article, the authors, analyzing the situation of settling property disputes over credit debts between spouses upon divorce, note some legal uncertainty in this area of legal relations. Based on the analysis of judicial practice, the authors note the ambiguity of the approaches of the courts in solving the problem under consideration, which leads to lengthy litigations, emphasize the need for further legislative settlement of this problem, without shifting the burden of credit debt to one of the former spouses.
