The history of the emergence and recognition of ownership of unauthorized construction

The features of the historical aspects of the formation and development of the right of ownership to unauthorized construction are analyzed. Issues related to the emergence and development of the definition of «unauthorized construction», arising from legal relations, are investigated, as well as the civil law consequences of unauthorized construction are determined. The significance of pre-revolutionary, Soviet and modern legislative acts that significantly influenced the development of the institution of unauthorized construction in the Russian Federation is considered. The purpose of the study is to identify the historical stages in the development of the institution of unauthorized construction, to determine the personal characteristics of each period, as well as to analyze this area in modern times. As general scientific and particular scientific research methods, the following methods were used: synthesis, analogy, description, formal-logical, systemic, comparative-legal and historical methods of scientific knowledge. The results of the study are that the conclusions of the study are aimed at deepening and expanding scientific ideas in order to understand the essence and legal nature of the features of the process of recognizing ownership of an unauthorized construction. As conclusions about the practical significance of this study, it can be assumed that the material obtained can be used as a guideline for building an improved institution of unauthorized construction based on historical experience.
