Typical violations detected by prosecutors in the supervision of compliance with the legality in the field of protection of the population and territories from emergency situations

Conducting inspections is an important component of the supervisory activities of the prosecutor's office. Prosecutors who oversee compliance with laws in the field of protecting the population and territories from emergencies face numerous problems in terms of organizing supervision, identifying violations and taking preventive measures aimed at preventing the occurrence of disasters, emergencies and incidents. Legislation in this area is constantly being improved, the authorities and local self-government bodies adopt normative acts regulating certain areas, and as a result, new types of violations appear. The prosecutors are faced with complex tasks, recognized to ensure the rule of law and order in the area under consideration. The prosecution authorities exercise supervisory powers in accordance with the provisions of federal law, use the accumulated experience and knowledge. At the same time, an analysis of the practice of prosecutorial supervision over the observance of the rule of law in the field of protecting the population and territories from emergency situations indicates the diversity of detected violations in various areas, the emergence of new types. This article is devoted to the typology of detected violations and measures of prosecutorial response. The author proposes a classification of violations, provides their characteristics with examples from the practice of prosecutors exercising supervision in this area.
