Evolution of human legal consciousness. Paradigm shift

In this study, the author defines the legal consciousness of a person as a part of consciousness, and therefore as a cybernetic category: he considers it as one with the behavior of a person and his life results. This approach provides an applied understanding of the algorithm of actions to improve the punishment system with a focus on the complete correction of criminals, as well as crime prevention. Using the interdisciplinary approach of cybernetics as the science of information flow management, victimology as a branch of criminology, the theory of reproduction of K.Marx, who discovered the objective laws of nature, the laws of physics of I.Newton and the theory of relativity of A. Einstein, discoveries in the field of medicine and biophysics of V. Kaznacheev, as well as the interdisciplinary theory of evolution as a learning of E.Kunin, M.Katsnelson, Yu.Wolf and V.Vanchurin, the author considers the evolution of legal consciousness as an initially given vector of progress, a vector co-directed to life as a whole. Thus, the author puts an equal sign between evolution and striving for a standard, an ideal. From this point of view, the question of faith is raised as “the realization of the expected and confidence in the invisible” [5, p.1320], as, in fact, a vector of evolution. At the same time, the author does not deviate from the cybernetic approach, defining the standard as information purified from duality and ignorant concepts, embedded in a person and in accordance with which it is necessary to bring the content of his consciousness. Relying on A. Einstein and his own research on consciousness, as well as defining legal consciousness in this study as a cybernetic category that controls not only human behavior and human life outcomes, but also affects the existence of states themselves and any institutions of power, the author determines the phases of the evolution of legal consciousness, draws conclusions about the need to change the paradigm of science, as well as the need for full independence of science from government and corporate funding. Science, according to the author, should become a new ideological supranational institution that determines the vector of development of society around the world in order to improve the quality of life and unlock the potential of each person.
