FEATURES OF THE IMPLEMENTATION OF THE RIGHT TO DEFERMENT FROM CONSCRIPTION FOR MILITARY SERVICE OF CITIZENS STUDYING IN RELIGIOUS EDUCATIONAL ORGANIZATIONS

The relevance of the article is determined by the importance of administrative and legal relations that arise between subjects in the field of conscription of citizens for military service. At the same time, the legislator emphasizes the right to deferment from military service for several categories of students, and regulates the specifics of the implementation of this right. At the same time, the consolidation of the right to deferment from the call of students of spiritual educational organizations occurred relatively recently, and therefore the provisions of the relevant regulatory legal acts and law enforcement practice require additional analysis. The purpose of the article is to identify the regulatory impact of the norms of the legislation of the Russian Federation in terms of the realization by students of their rights. As part of the study, an analysis of legislation and law enforcement practice was carried out through the application of general scientific methodology, as well as formal legal and comparative legal methods. The results of the study show that in order to implement the legally enshrined right to deferment from military service of students in religious educational organizations, the recommendations developed by the author on the harmonization of legislation in the field of military service and education in the Russian Federation can be taken into account.
