PROBLEMATIC ISSUES OF QUALIFICATION OF FRAUD WHEN RECEIVING PAYMENTS BY MILITARY PERSONNEL

the article analyzes the main problems that arise in the process of qualifying fraudulent actions carried out by military personnel to illegally receive various payments. Thus, based on the analysis of judicial practice, the researcher identified the criteria by which the law enforcer qualifies in some way similar crimes committed by military personnel in the field of payments, under articles 159, 159.2, 159.5, as well as other articles of the Criminal Code of the Russian Federation. In addition to the above, the author of the article proposed a model for amending the Criminal Code of the Russian Federation in order to reduce the mass nature of the commission of such crimes by military personnel.
