GAPS AND CONFLICTS OF LAW AS A DESTABILIZING FACTOR

The article examines conflicts and gaps as destabilizing factors of law in general. It is noted that the problems stated for analysis include two aspects: gaps and conflicts in the legal system; gaps and conflicts in the legal system. The authors emphasize the lack of a unified approach to the chosen research problem among legal scholars and practicing lawyers. The position is consistently justified, according to which gaps and conflicts arise under the influence of certain factors that have a significant impact on the development of the legal system and the legal system in a particular state. Such factors include the socio-economic development of the state, legal awareness, legal culture, legal technology, legal policy, political regime, will and professionalism of the norm-setter, the level of development of legal science, the degree of communication of the scientific community with practitioners.
