ON THE ISSUE OF LEGAL REGULATION OF THE INVESTIGATION BY THE INVESTIGATOR

Analyzing the criminal procedure norms and established judicial practice, the author in the article expressed the position that the criminal procedure law does not adequately regulate issues related to the implementation by subjects of procedural control (the head of the investigative body, the prosecutor) of their powers in relation to the investigator conducting the inquiry. The author demonstrates how the head of the investigative body and the prosecutor exercise their control powers over the investigation by the investigator, pointing out the existing gaps in the legal regulation of the legal relations under consideration and concludes that the criminal procedure law requires the regulation of a uniform procedure for the investigation of a criminal case by special subjects (investigators of the Investigative Committee of the Russian Federation) in terms of the exercise of powers How to make an inquiry, so is the implementation of procedural control over the actions and decisions of the investigator. It is proposed to amend the Criminal Procedure Code of the Russian Federation, clarifying the powers of the investigator of the Investigative Committee of the Russian Federation for the conduct of an inquiry, adding the empowerment of the head of the investigative body to instruct the investigator to conduct an inquiry in a criminal case, to approve an indictment or an indictment in a criminal case; to draw up a written notification of suspicion of committing a crime.
