This article examines the qualifying features of a crime providing for criminal liability for illegal trafficking in pollutants, sources of infectious diseases, toxic and hazardous waste, united by the concept of particularly serious environmental pollution - an especially grave consequence of a crime. This article is a direct logical continuation of the study of the features of a crime provided for in Art. 338 of the Criminal Code of the PRC, taking into account Amendments No. 8 of February 25, 2011 and No. 11 of December 26, 2020 to the Criminal Code of the PRC; official explanations of the content and procedure for applying criminal law in the field of environmental protection in the PRC; published materials of Chinese judicial and investigative practice and monographic studies.
