THE RELATIONSHIP BETWEEN FREE WILL AND RELATED CATEGORIES

The article examines the correlation between the concepts of free will, law enforcement discretion, and judicial discretion within the context of legal activity. The author proposes an original approach to defining the content of these categories, revealing their theoretical and legal foundations as well as their significance for law enforcement practice. A comparative analysis of the features of each category is conducted, identifying their common and distinctive characteristics, as well as the criteria for their differentiation. Particular attention is paid to the relationship between free will and both judicial and law enforcement discretion, which allows for clarification of the limits of discretion and the role of the legal actor in the implementation of legal norms.
