«QUALIFIED» EVASION OF MILITARY SERVICE

Considering the stated topic, the author was one of the first to draw attention to the gap in the study of forms of evasion from military service, which traditionally places emphasis on the «problems of the little man» and misses certain processes occurring in Russian society [7; 8; 9, p. 583–585, 608–612]. The form of reluctance he defines to fulfill military duty is for the most part latent in nature, and therefore is not fully identified in the public sphere and is not covered by the criminal law policy of the state. At the same time, it exists and is associated with the temporary employment of interested persons in bodies and institutions of public authorities, which provide a deferment from conscription for military service for the period of work in them [5], while the incentive for employment is the reluctance to perform military service. This form requires individuals to have certain social connections, a certain educational level and qualifications, and therefore it is conditionally defined as qualified. The author concludes that this method of evading service does not contribute to the strengthening of Russian statehood, since the bodies and institutions that provide deferment are composed of not fully motivated workers, and the potential of the Armed Forces of the Russian Federation is also weakened, which is unacceptable in the conditions of special military operation and other external military threats.
