POLITICAL, LEGAL AND STATE VIEWS OF PRINCE M. M. SHCHERBATOV

Shcherbatov was an obvious ideologist of the corporate aspirations of the Russian nobility, substantiated the natural rights of this class. Among his works one can name the treatise "On the Corruption of Morals in Russia". Shcherbatov M. M. adhered to the basic principles of natural law theory and the concept of the contractual origin of the state. Analysis of the historical experience of mankind leads M. M. Shcherbatov to the idea that "equality of status was possible only in a wild way". The prince criticized the attitude of nobles to the laws, who in the performance of their duties were guided not by the principle of legality, but by their own interests. In analyzing the forms of government and state laws, Shcherbatov focused on such factors as climate, size of territory, geographical features, fertility of the land and population. The political, legal and state views of the prince can be characterized as a combination of traditionalism and the desire for renewal.
